Fraud and corruption accused Schabir Shaik faces new charges of crimen injuria and intimidation following an alleged racial incident outside the Durban High Court yesterday morning.
South African Police Service spokesman Vishnu Naidoo said a white policeman stationed at the court laid the charges after claiming he was "verbally and racially assaulted" before the resumption of Shaik's trial.
According to witnesses, an argument started when Shaik was prevented from parking in the high court premises.
Court policemen told Shaik that he could not park on site as a car carrying his legal documents had already been allowed into the area and Shaik only had one allocated parking bay.
Shaik, who had previously been allowed to park at the court, allegedly then accused a policeman of racism and asked why whites were allowed inside the parking area.
Although Naidoo refused to say against whom the charges were laid, Mo Shaik confirmed it was his brother Schabir.
"It's one more charge, no problem," Mo Shaik said.
However, Shaik's attorney, Reeves Parsee, would not comment, saying he had no knowledge of the incident.
Meanwhile, KPMG forensic auditor Johan van der Walt was unwavering yesterday, the first day of his cross-examination.
Van der Walt repeatedly told defence counsel Francois van Zyl that he stuck to his conclusions, detailed in the 250-page report.
