• That Jacob Zuma received substantial payments from Shaik and his companies from 1995 to 2002 and beyond. The aggregate of the amount paid to Zuma as at July 1 2005 was R4 072 499.
• That Zuma assisted Shaik and his companies in their private business interests.
• That the payments were made with the intention that Zuma should provide his official assistance in return.
• That the Thales group, including Thint, through the intermediation of Shaik, offered to pay Zuma an annual bribe for his protection against the investigations into the arms deal, and that Zuma accepted this offer.
• That Thomson and Shaik sought to disguise the payment of a portion of this bribe by means of a false service provider agreement, and that they intended to use the false service provider agreement to facilitate further payments in accordance with the bribe agreement.
• That payment of the full amount due to Zuma in accordance with the bribe agreement of R500 000 per year from about mid-2000 has not been identified and that the possibility of payments in addition to the money that Thomson/ Thint laundered through their Mauritius subsidiary to Shaik for Zuma remained.
