Zuma's lawyers are to lodge an application on Monday for leave to appeal the
Durban High Court's decision allowing prosecutors to ask the Mauritian
authorities to re-lease documents about meetings believed to relate to arms deal
corruption.
On April 2 Judge Phillip Levensohn handed down his decision
allowing prosecutors to travel to Mauritius.
The decision to appeal was
taken shortly afterwards.
Zuma's attorney, Michael Hulley, also said it
"would be improper and premature" to indicate which points of Levensohn's ruling
would be contested in an appeal.
Should Levensohn reject the appeal, then
Zuma could petition the Supreme Court of Appeal in Bloemfontein.
The
documents the State seeks include the 2000 diary of Alain Thetard, the former
CEO of Thales International's South African subsidiary Thint (Pty) Ltd, which
reportedly details a meeting in March 2000 between him, Zuma and convicted
fraudster Schabir Shaik.
The NPA alleges that an agreement on a R500
000-a-year bribe for Zuma was reached at this meeting.
