The Department of Correctional Services is awaiting the completion of a full report that will update them on convicted fraudster Schabir Shaik's medical condition.

Department spokesman Luphumzo Kebeni said doctors were currently compiling a report on Shaik's present condition.

"We have requested that we be able to send in medical people to compile the report," he said.

"This report will help us to make a decision on the next course of action."

Meanwhile, Shaik is still in hospital and is receiving treatment from doctors for chronic unstable high blood pressure.

This is according to his brother, Mo Shaik, who said that doctors at St Augustine's Hospital were trying to decide on the next step in his brother's treatment.

Mo said that Shaik's condition remained unchanged.

Shaik was found guilty of two counts of corruption and one of fraud by Judge Hilary Squires in the Durban High Court in July 2005 and was sentenced to 15 years in jail - a verdict upheld by a full bench of the Supreme Court of Appeal on November 6.

His lawyers then lodged papers with the Constitutional Court appealing against his corruption and fraud conviction and jail sentence. Shaik's lawyer, Reeves Parsee, said the State now had until February 15 to file opposing papers *1.

*1       Why oppose: agree to the convictions and sentences being set aside on the basis that all three co-conspirators were not tried together and then try them all together.
