Shaiks's brother Mo told SABC: "As far as petitioning the President is concerned, (we) will consider that. But we think it would be easier because of his medical condition.
"We could even write to the President on the basis of compassionate grounds to consider supporting a medical parole."
Mo Shaik said his brother suffered from a resistant type of hypertension.
Shabir Shaik has been admitted to hospital three times since entering prison late last year.
Recently, he was readmitted to the Inkosi Albert Luthuli hospital in Durban after suffering a mild stroke.
Mo Shaik said the family was considering correctional supervision and medical parole.
However, legally medical parole is only granted in the case of terminally-ill prisoners in an advanced stage.
The Shaiks could apply to the courts or seek presidential pardon to try obtain his release on these grounds.
