The government has today supplied the International Offers Negotiating Team and Financial Working group papers that were awarded to ECAAR-SA by the Cape High Court on March 26 2003. ECAAR-SA has agreed to postpone sine die -- until satisfied that the documents furnished are complete -- its application scheduled for today for a declaration that the President, the government and the Minister of Finance are in contempt-of-court.
These documents, in combination with the British-South African government loan agreements and other documents already held, will enable ECAAR-SA to proceed with the hearing on February 17 2004 for the loan agreements that give effect to the arms deal to be set aside as unconstitutional. Such a judgment, we believe, will cancel the arms deal.
