Overview of the Promotion of Access to Information Act No.2 of 2000

Definition

To give effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights; and to provide for matters connected therewith.

Part 7 General Provisions

Liability

89. No person is criminally or civilly liable for anything done in good faith in the exercise or performance or purported exercise or performance of any power or duty in terms of this Act.

Offences         

90. A person who with intent to deny a right of access in terms of this Act -

(a) destroys, damages or alters a record;
(b) conceals a record; or
(c) falsifies a record or makes a false record,

commits an offence and is liable on conviction to a fine or to imprisonment for a period not exceeding two years.

In the interests of open democracy, transparency and good governance, the Auditor-General, Public Protector and National Director of Public Prosecutions have lodged a notice of appeal on 2002-12-06 against the judgement in the Pretoria High Court against them concerning my application for review in respect of the Auditor-General's refusal to grant access to records under the Promotion of Access to Information Act.
